Unlock Your American Dream

EB-2 NIW Pathway for Commercial Pilots

The EB-2 National Interest Waiver (NIW) Visa for U.S. Green Card application offers a unique opportunity for you to contribute your aviation expertise to the U.S. and become a permanent resident.

Foreign pilots with experience can apply for permanent residence without obtaining a job offer or labor certification. In April 2021, the US government recognized that it was of national interest to ease the travel and border control rules for foreign pilots and aircrew.

Why choosing EB-2 NIW Visa?

  • No Labor Certification Required: Unlike other visa categories, the EB-2 NIW doesn't require a labor certification, streamlining your path to a Green Card

  • Recognizing Your Expertise: Your experience as a commercial pilot is invaluable, and the U.S. acknowledges this by offering a more direct route to residency.

  • Flexibility in Employment: The EB-2 NIW allows for greater career flexibility once in the U.S., a significant advantage for pilots seeking diverse flying opportunities.

Who is eligible?

  • Exceptional Ability: Pilots with a proven record of exceptional ability in the aviation field.

  • Advanced Degree Professionals: Pilots holding advanced degrees or their equivalent in relevant fields.

  • National Interest: Your employment must be seen as benefiting the U.S. national interest significantly.

What are the minimum requirements to apply for the EB-2 NIW Program?

At least 3 of the following items must be fulfilled:

  1. Degree, diploma, certificate relating to the aviation industry.

  2. 10 years full-time work experience as a pilot.

  3. A valid license to practice your profession.

  4. Evidence that you have commanded a salary showing your exceptional ability.

  5. Membership in a professional pilot association(s).

  6. Recognition of achievements in the aviation industry from peers, government entities, professional or business organizations.

  7. Other comparable evidence (anything that makes your training and/or experience special or noteworthy, including management and/or training duties).

Note that in certain circumstances, applicants may apply without meeting 3 criteria, provided that they hold a qualifying university degree at least equivalent to a U.S. Bachelor.
